These Regulations correct an error in the Environmental Impact Assessment (Forestry) Regulations (Northern Ireland) 2006 (S.R.2006 No.518) (″the 2006 Regulations″). Regulation 18(10) of those Regulations provides for the penalty for a summary offence (failure to obey a summons). That penalty is described as a fine not exceeding the statutory maximum. The appropriate maximum penalty for such offences is level 5 on the standard scale. These Regulations amend the provision accordingly. The Regulations also revoke the Environmental Impact Assessment (Forestry) (Amendment) Regulations (Northern Ireland) 2002 which amended Regulations revoked by the 2006 Regulations.
